Overheard in the Office...

Me: "'They had been given the chance to convict Zimmerman of manslaughter but did not do so, despite asking for a clarification of the charge earlier in the evening.' They failed! How could they have failed? He's going to get off on a technicality! The technicality of being not guilty!"
What media bias?

I'm nearby this mess in Florida. I am prepared for the worst. I hope sanity prevails.
But am prepared if it does not.

He's going to get off on a technicality!

The twits that shout that from the rooftops are really clueless.
How many soldiers have died in the last 200 years to protect those "technicalities"?

I'm glad this jury was able to see the facts in spite of all the kangaroos bouncing around.

Zimmerman's still hosed. There's a price on his head, and "social justice" demands his death. Let's hope he sues the shit out of MSNBC (for editing the 911 tape) and CNN (for displaying his SSN on air) and can buy an island somewhere.

I'd like to prosecute the media.
If found guilty,,,,as obviously they are..
Prosecute the OWNERS of the media.
Put them in a pit and feed them their fellow fuckwads.

I hope zimmerman sues them too..and uses the money as a man of good will.

Karma. Eric Holder is still running around free, doing his absolute best to screw up this country. Obama hasn't been impeached and tried for treason. Both are black. Karma is just evening the scales by letting an innocent non-black be acquitted.

Steve, he's going to need the money he sues MSNBC for to cover his own expenses...welcome to the Wrongful Death Civil Trial...

Those same instructions include the definitions of justified homicide and excusable homicide.

Zimmerman is immune from civil suit in FL due to having been acquitted from all the criminal charges. (Criminal charges here having a double meaning reflecting on prosecutor Corey as well.)

As to possible Federal charges, the FBI already investigated and concluded there was no basis for believing that racial animus was behind Zimmerman's actions. Therefore a further prosecution under Federal civil rights charges would be highly suggestive of politically motivated persecution to rational observers, but would play well to certain segments of the population, so I'm not ruling it out.

Mattexian said...

Mike_C, the IRS has gone after groups in what can only be described as "politically motivated persecution," what's to stop the FBI from feeling pressured by the boss to do similar work?

"Zimmerman is immune from civil suit in FL due to having been acquitted from all the criminal charges."

Why the hell isn't this the law of the land? A civil suit seems to me to be the definition of double jeopardy.

If I was Zimmerman, I'd be practising my EspaƱol and looking up the addresses of Mama's relatives in Peru.

I recall a fragment of something about Z surrendering his passport at a preliminary hearing, before they went back and arrested him after they replaced the police chief. Have they returned that yet, along with his pistol and CCW?

Will: Move out to the free zones.

Most western and southern states have passed victims' rights statutes.

Was the verdict "not guilty" or "factually innocent" It seems to me that your interpretation of Florida law is incorrect. If they can't make the 99 44/100 standard of criminal law, maybe they can make the preponderance of the evidence standard of civil law.
And as for this technicality crap. It's only a "technicality" if you don't like the result. What was the technicality that released Zimmerman? Perhaps the same technicality that saw Simpson walk out of Ito's courtroom lo these many years ago?

The media has to decide if they want to embolden muggers, rapists burglars robbers and murderers, or persuade them to take up lawful employment.

Tam said...

"What was the technicality that released Zimmerman?"

The technicality that the prosecution didn't have a shred of evidence to support their theory of events?

Windy Wilson said...

When the prosecution can't prove the case, that's the technicality that prevents a conviction. Tam, In this case, the prosecution could not prove the case for the reason you state. In the Simpson murder case, the prosecution was incompetent. The jury cannot imagine or extrapolate or make the case for the prosecution. It has to go with what it's given.

Now the Richard Hauptmann case. . .

As I understand it, and IANAL, Zimmerman can now immunize himself from civil suits with a Stand Your Ground hearing. This is the _only_ point where SYG enters into the case.

SYG has nothing to do with when you're pinned and your head is being used to test the Young's Modulus of the sidewalk. You cannot retreat, so whether or not you have a duty to retreat is irrelevant.

SYG has one relevant point. IF he can get out from under this judge, and get a fair hearing, oh and maybe get the tox report and phone data in showing TM was intoxicated, with a history of violence, MMA fighting skills, and drug use, the FL SYG law lets him have a hearing to affirmatively show that he acted in self defense. If he wins this hearing he is immunized against civil or criminal suits.

He could have done it earlier, but it would have been in front of this judge. Yeah, I'd have passed, too.
